ACOUSTIC.ART SLA

Policy Last Updated On: 2026-10-16

This Acoustic Art SLA is a contract between Permanent Media Corporation, a corporation incorporated under the Canada Business Corporations Act with its registered office in Saskatchewan, carrying on business as acoustic.art, and the person who opens an account, uploads a design, publishes a design, or pays for a wall, a kit, a render token, or exclusivity. Contact is support@acoustic.art.

This instrument alone governs acoustic.art. The Host agreement, the Agency agreement, and the Contractor agreement do not.

You accept this SLA by a clear affirmative act when you first publish a design, and again when you pay for an order. An unchecked box is not acceptance. If you do not accept, do not publish and do not pay.

ACCOUNTS

An account is the email address you give us. We send a one-time code to that email. A code accepted for that email binds the account. You keep control of the inbox. We may close an account that breaks this SLA.

UPLOADS

You warrant that you own the image you upload, or that you hold every right required to upload it and to let us do what this SLA says. You warrant that the image does not infringe a third party’s copyright, trademark, or right of publicity. You will not upload unlawful content, and you will not upload sexual content involving a minor. You indemnify Permanent Media Corporation against a claim that arises from the image you upload.

PUBLISHED DESIGNS

A design you have not published stays private. When you publish a design, you grant Permanent Media Corporation a non-exclusive worldwide licence to display the preview, to manufacture physical copies, and to sell those physical copies. You keep the copyright in your source image. The compiled cut file is our manufacturing record. We do not deliver it to you. We may remove a published design from public display. A physical copy already sold stays sold.

The studio uses an art-director model and our own engine. The engine writes the geometry. We do not promise that the compiled geometry is an original copyright work in every country, and we do not promise that it is free of resemblance beyond the warranty you give on your upload.

ROYALTY CREDIT

Royalty Credit is a non-cash ledger balance of $10.00 United States dollars for each paid wall order of a published community design. It is credited to the original creator of that design. A later resize that derives from that design still credits the original creator. No credit accrues when the buyer is the creator. Royalty Credit cannot be redeemed for cash, cannot be transferred, and can be applied only to the goods price of a physical wall the creator buys. Freight and tax stay at full amount.

EXCLUSIVITY

Exclusivity is the retirement of a design from public display and from further sale, for a fee of $150.00 United States dollars. On payment we remove the design from public display, we stop new sales of physical copies, and we keep the cut file locked. Your copyright in the source image is unchanged. You do not receive the cut file. The fee is earned when the design is retired.

MODERATION AND NOTICE

We may remove a design and we may close an account. A person who claims a right in a published design sends the claim to support@acoustic.art, with a description of the design, the right claimed, and a contact address. Removal is not an admission.

READY TO SHIP

A ready-to-ship piece is one finished physical piece. We sell that piece once. You take it at our Saskatchewan micro-lab, or you take delivery under a separate freight quote for truck shipment in North America. You inspect a pickup before you take the piece. You inspect a delivery when it arrives. A defect you can see at that inspection and do not reject is accepted. A hidden manufacturing defect, meaning a cut or size failure that you could not see at inspection, is notified to support@acoustic.art promptly after you find it. Risk of loss passes when you take the piece at the micro-lab, or when the piece is delivered to the address on the order.

CUSTOM WALLS

A custom wall is made only after you pay a quote. The quote stays open for 14 days. An unpaid quote expires at the end of that period. The quote states a supply date before you pay. A later supply date replaces it only when you and we agree to that date in writing. Once manufacture has started, we will refuse a commercial cancellation. You may still reject a manufacturing defect, and you may still cancel where The Consumer Protection and Business Practices Regulations, RRS c C-30.2 Reg 1, section 3-8 gives you that right.

DIY KITS

A DIY kit is a set of pressure-sensitive-adhesive tiles. You install the kit. You prepare a surface that is clean, sound, and dry. We do not install it. The kit is shipped by air parcel to the address on the order. Import duties and brokerage are payable by you to the border authorities. We do not collect them.

RENDER TOKENS

A render token is a digital allowance. It is supplied to your account when payment succeeds. A token that has been supplied is not refunded as a matter of contract. A cancellation right under section 3-8, where it applies, still applies.

PRICE AND TAX

The goods price is exclusive of tax. Before you pay, we show the tax that the delivery address attracts, the freight if any, and the total. Amounts are in United States dollars. This SLA states no tax rate table and no tax calculation method. Import duties on a DIY kit are additional charges we do not determine.

SHIPPING

Pickup is at our Saskatchewan micro-lab. Truck freight for a ready-to-ship piece or a locally built custom wall is a separate quote, at the amount quoted, for delivery in North America. A DIY kit moves by air parcel. The place of delivery is the micro-lab for a pickup and the address on the order for a shipment. We email a copy of the contract to the account email within 15 days after you pay.

WARRANTY

At the moment risk passes, a ready-to-ship piece and a custom wall match the size and layer count ordered and are free of a cut error that makes the piece unusable. We have the right to sell the physical piece. Colour, felt texture, and the on-screen preview are not a match standard. Adhesion of a DIY kit depends on the surface you prepare. We do not warrant adhesion to that surface.

LIABILITY

Our aggregate liability arising out of an order is the amount you paid us for that order. We are not liable for lost profits, a lost project, or the cost of installation on a surface we did not prepare. A right that a statute refuses to let us limit remains in force.

DEALER ADDENDUM

A dealer is a person we invite, in writing, to buy for resale or for a client installation. A self-declaration does not make a dealer. The dealer receives an exclusive wholesale discount on the goods price on a ready-to-ship piece and on a custom wall. Dealers are prohibited from publicising their wholesale discount. Doing so may result in revocation of their wholesale status. Freight, tax, render tokens, and the exclusivity fee are charged in full. The dealer owns the final mile and the installation, and the liability that comes with both. The rest of this SLA still applies. A dealer buys in the course of business.

LAW

This SLA is governed by the laws of Saskatchewan and the federal laws of Canada applicable there. The courts of Saskatchewan are the forum. A consumer-protection right that the law of the buyer’s home refuses to let us waive remains in force. We may post a new notice. Policy Last Updated On is the date of that text. Publishing or paying accepts the notice then shown. A new version binds the next publication and the next order. An order already paid keeps the version accepted at payment.

SCHEDULE: CHECKOUT DISCLOSURE

Before a buyer can pay, checkout shows the following, in a form the buyer can access, keep, and print. The buyer can accept or decline, and can correct the order and the delivery address, immediately before paying.

The supplier is Permanent Media Corporation, carrying on business as acoustic.art. The telephone number and the street address of the premises from which we sell are shown in full. Those two values are inserted before any live sale. Email contact is support@acoustic.art.

The description states what is being bought: one ready-to-ship piece, with its size and layer count; a custom wall; a DIY kit of pressure-sensitive-adhesive tiles; a render-token allowance; or exclusivity. The description includes the technical facts that matter, including size, layer count, and that a ready-to-ship piece is unique.

The prices are itemized. The goods price, the tax, and any freight are separate lines. The total payable is shown. The currency is United States dollars. Payment is by the card form on the checkout. Import duties and brokerage on a DIY kit are described as charges the buyer pays outside checkout, which we do not determine.

The supply date is a calendar date. Render tokens are described as supplied to the account when payment succeeds. Exclusivity is described as retirement of the design when payment succeeds. For a shipment, the carrier, the method, and the place of delivery are the ones on the order. For a pickup, the place is our Saskatchewan micro-lab. We do not provide installation. A dealer who buys under the addendum assumes installation.

The cancellation, return, and refund terms are the terms in this SLA. There is no trade-in. The other conditions are the conditions in this SLA.

Within 15 days after payment, we email a copy of the contract to the account email.
